PLAYER REGISTRATION

**Please read Waiver in its entirety and sign below:**

WAIVER AND RELEASE FROM LIABILITY. This is an important, legal document. READ THIS ENTIRELY before signing. Signing this document is significant because you are waiving the right to make a claim against or sue Cunniff Hockey LLC [hereinafter, "The Camp"] under certain circumstances. This agreement waives and releases The Camp from liability for negligent acts of its owners, directors, employees, volunteers, agents and their successors or assigns. This waiver is applicable to the participant, his or her parents, guardians, personal representative(s), executor, heirs, successors and assigns. HOCKEY IS A DANGEROUS CONTACT SPORT. It involves physical contact and exposes participants to various potential dangers. THIS WAIVER AND RELEASE AGREEMENT APPLIES TO injury, death, property damage, or other events that occur as part of the normal risks of playing hockey, as well as injury, death, property damage, or other events resulting from the negligent acts of The Camp, its owners, directors, employees, volunteers, agents and their successors or assigns. 

These risks include: 

• Injury, death, or property damage caused by participation with other camp attendees including bigger, faster, and stronger camp attendees; 

• Injury, death, or property damage arising from the inherent danger and foreseeable risks of pucks, sticks, skates, goal nets, ice, training equipment such as cones, boards, and arena glass that may occur at the facility where the camp is held including the ice surface, lobby, and locker-room areas. 

• Property Damage includes property that may be lost, stolen, or damaged as a result of the typical and foreseeable risks of playing hockey 

YOU MAY BARGAIN FOR SOMETHING DIFFERENT. This form asks you to waive and release right to make claims for injuries and damages caused by the negligence of The Camp. You have the right to bargain for a different type of waiver and release or for no waiver and release at all. If you want to bargain, contact Cunniff Hockey LLC. By signing this form you acknowledge that you have the right to bargain for different terms and have executed that right. 

THE UNDERSIGNED PARENT/PARTICIPANT OF___________________________________ (participant’s name) who is attending Cunniff Hockey Camp hereby acknowledges: 

1) This waiver and release is a document that has the sole purpose of waiving and releasing The Camp from certain liabilities. 

2) I understand what is being waived. 

3) I am aware of the nature and significance of what is being waived. 

4) I have been provided an opportunity to bargain the terms and conditions of this agreement.

5) I am voluntarily assuming the risks, both known and unknown, associated with participation in The Camp. 

I agree, for myself and/or my child, to RELEASE from liability, forever indemnify, defend, and hold harmless The Camp. and their owners, officers, directors, volunteers, employees, affiliates, agents and assigns, (collectively as 'RELEASEES') from liability for any and all loss or damage to myself or to my child or my or my child's property resulting from the RELEASEES' NEGLIGENCE or any other cause. I understand that the RELEASEES are not responsible for the consequences of their own NEGLIGENCE, that is, their failure to use reasonable care in any way. I acknowledge that I am freely and expressly assuming and accepting any and all risks of property damage, personal injury and death in connection with my or my child's participation in the Camp. I hereby acknowledge that indemnifying the RELEASEES includes paying for any and all attorneys' fees, costs, or other tangible losses related to any claims brought that are covered by this waiver and release. 

Participants under 18 years of age: As parent/guardian signing this agreement for the named minor, I acknowledge and agree that I have read the above release of liability and that by submitting this purchase transaction, this release, executed on behalf of the minor, I and the minor agree to be bound by its terms. I hereby agree to RELEASE from liability, forever discharge, indemnify and hold harmless RELEASEES' for any claim or suit arising out of said minor's use of the resort, the facilities, any rental equipment, and participation in skiing/snowboarding including instructional lessons.

I agree, for myself and/or my child, to that any claim brought against The Camp shall be submitted to the jurisdiction of the State or Federal Courts in the Commonwealth of Massachusetts and in no other jurisdiction. Any claim brought shall be governed by the laws of the Commonwealth of Massachusetts.

CODE OF CONDUCT FOR CUNNIFF HOCKEY CAMP 

Participant____________________________________, Dated:________________________ intends to participate in a hockey camp, (The Camp) sponsored by Cunniff Hockey Camp, LLC (The LLC). The participant, either individually or by his/her parents hereby consents to all recording, photographing and filming of Participant in connection with The Camp and hereby grants The LLC, without limitation, the right to use Participant's name and likeness in connection with The Camp for any publicity, advertising and/or other commercial purposes without compensation or further permission. Parent/Guardian on behalf of Parent/Guardian personally and Participant acknowledges that The LLC has a zero tolerance policy with respect to uncontrollable behavior, bullying, hazing, alcohol, tobacco, drugs and controlled substances, weapons of any kind or any other activity which The LLC deems illegal or not in conformance with civilized standards of conduct and agrees to abide by this zero tolerance policy for the safety of all participants, guests, and employees. In connection with the above policy, Parent/Guardian grant The LLC the right to inspect any and all personal belongings of the Participant at any time on or off the The Camp’s location. Any consequences that come as a result of violating this policy are at the sole determination of The LLC and any dismissal from The Camp due to a policy violation will not result in a refund.
